About
New York requires spouses to be residents of the state for at least one year before filing for divorce. Exceptions include grounds for divorce occurring in New York, cruel and inhuman treatment, and separate maintenance. To establish residency, one must show a New York driver's license, voter registration card, lease or deed to a Residency Requirements for Divorce in New York, or affidavits from witnesses. Failure to meet residency requirements may result in delayed divorce proceedings, increased costs, and loss of jurisdiction.
