About
New York law distinguishes between "marital property," which includes most assets and debts acquired by either spouse during the marriage, and "separate property," which New York State Divorce Laws Marital Property generally includes items owned prior to marriage, inheritances, and gifts given to one spouse only. Only marital property is subject to division in a divorce.
